The Court of Appeal sitting in New York, United States (US), Justice Justice Ellen Gesmer, has Rejected President Donald Trump’s request to delay his sentencing in the hush-money case.
Trump, convicted in May 2024, of 34 counts of falsifying business records, is scheduled to be sentenced on Friday, January 10, 2025.
Trump’s legal team argued for a postponement, citing his status as President-elect and claiming immunity from prosecution should extend to a president-elect.
However, Justice Gesmer rejected these arguments, stating, “After consideration of the papers submitted and the extensive oral argument, the movant’s application for an interim stay is denied.”
The case revolves around allegations that Trump falsified business records to conceal a $130,000 payment to adult film actress Stormy Daniels during the 2016 presidential election.
Judge Juan Merchan, who presided over the trial, has indicated he is not inclined to impose jail time and is leaning towards an unconditional discharge.
Despite the conviction, Trump will enter the White House as a convicted felon when sworn in as president on January 20, 2025.
Legal experts note that while Trump faced up to four years in prison, his sentencing is expected to avoid incarceration.
